PLEASE NOTE THE UPDATE OF THIS CLASS ACTION SETTLEMENT: With respect to the above issue, USCIS and the complainants have agreed to an agreement on the settlement agreement for cases in which the application for a status adjustment was rejected, revoked or revoked by the state on the date of the applicant`s court order. USCIS will not refuse, revoke or terminate an SIJ petition (Form I-360) or a status adjustment based on the SIJ (Form I-485) if the applicant is not married at the time of filing the SIJ petition (1) under the age of 21 and is authorized by other means and (2) is the subject of a valid dependency decision or has been the subject of a valid dependency order that has ended on the basis of proof of prior notification. This system applies to all youth who are not U.S. citizens and who applied on or after May 13, 2005 or who wish to apply for immigration status because they have been abused, abandoned or neglected. Some individuals whose application for the classification of Special Adolescent Migrants (SIJ) and/or request ifj to adapt status were rejected or revoked on 13 May 2005 may apply to reopen the rejected YIS application (Form I-360) or the application for a status change (Form I-485).
